1. Use of content

Go Eco grants a non-exclusive, non-transferable license for the term of the CRP programme, to access, download, display, and print content from the site, solely for your organisational use, provided that you do not modify the site or material content in any way. Go Eco retains all copyright displayed in the site content.

2. Intellectual Property

Go Eco owns all licences and intellectual property rights in this website, including its text, graphics, logos, images, calculators, methodologies, software, resources and other content.

Users may not reproduce, modify, distribute, publish, sell, licence, commercially exploit, generate revenue from, reverse engineer, or create derivative works from any part of the website or its content without the prior written consent of Go Eco.

Any unauthorised use of Go Eco intellectual property may result in suspension or termination of access and may be subject to legal action.

3. Acceptable Conduct

Users agree that nothing will be done to alter, interfere with, or damage the website's functioning. You will not release anything that may harm or change the website, such as a computer virus or other destructive element.

4. Interactive website

Under the Community section forum, users interact and share information. You agree by using this function that you will not share other organisations information, or post confidential, proprietary or commercially sensitive information belonging to another organisation without authorisation.

Go Eco reserves the right to remove content, restrict participation or remove users where content is considered inappropriate, misleading, offensive, defamatory, unlawful or inconsistent with the purpose of the platform.

If any of these terms are breached, we reserve the right to remove the user from the site and may take further action.

5. Authenticated access

Go Eco uses reasonable technical and organisational measures to protect information stored on the website from unauthorised access, loss, misuse or disclosure.

Users are responsible for maintaining the confidentiality of their login credentials and for all activities undertaken using their account.

6. Backup and Data Loss

While Go Eco maintains backup and recovery procedures, users are encouraged to retain copies of important reports, plans and records.

Go Eco is not liable for any loss of data arising from system outages, cyber incidents, technical failures or circumstances beyond its reasonable control.

Go Eco may suspend, restrict or terminate user access where these Terms are breached or where continued access presents a security, operational or legal risk.

7. User-Generated Content

Users retain ownership of any information, plans, reports, data, documents or other content they upload to the website. By uploading content, users grant Go Eco a non-exclusive licence to store, process, display and use that content solely for the purpose of operating, maintaining, supporting and improving the CRP platform.

Users are responsible for ensuring they have the necessary rights and permissions to upload any content they provide.

8. Disclaimer and Liability

Go Eco will not be responsible for any errors or omissions, or for the accuracy of the results obtained from the use of the calculator, actions or resources. All information from this site is provided "as is", with no guarantee of total accuracy. We provide this information to our users to the best of our ability and on good will.

Emission multiplication factors are based on Latest Ministry of Environment data. Go Eco will make reasonable effort to make sure they are kept up to date with the latest factors, but Go Eco cannot guarantee continued emissions factor updates. Some multiplication factors are averaged for ease of calculation for certain calculations. Allowance for use of custom factors has been built into the calculator.

Go Eco and their funders do not accept liability in the event of emissions calculation error, other incorrect calculations or plans or omissions - all reasonable effort is made to supply and update as accurate information as possible when using and updating the portal.

Go Eco is not liable for subsequent decisions made by users based on any data, plan or information obtained from this software or the use of the portal.

Although the calculator uses the latest MfE factors for emissions, we cannot guarantee the robustness of the results from this site, and that accurateness would unlikely be sufficient to audit.

Go Eco, does not make any warranties regarding the material and facilities contained or referred to in this site.

Go Eco does not accept any liability, for any reason whatsoever, for any loss or damage which may arise in any way from the use of the website, the materials or accuracy of any information obtained through use of this site.

Go Eco may change, delete, add to, or otherwise amend information contained on this website without notice.

The contents of this website should not be construed as legal or professional advice.

Users agree to indemnify and hold harmless Go Eco, its trustees, employees, contractors and funders against any claims, losses, liabilities, damages or expenses arising from misuse of the platform, breach of these Terms, or infringement of third-party rights.

9. Governing Law

These Terms are governed by the laws of New Zealand and any disputes arising from the use of this website shall be subject to the jurisdiction of the New Zealand courts.
